Terms of Sale
Please read these terms carefully before participating in any HeritageBids auction.
Introduction
These Terms of Sale govern all purchases made through HeritageBids (auctions.heritagebids.com). By registering to bid or purchasing any lot, you agree to be bound by these terms in their entirety.
1. The Auction
HeritageBids conducts online auctions in which registered bidders compete for individual lots. Each auction has a defined start and end time, communicated in advance through the auction catalog.
All auctions are conducted in US Dollars (USD) unless otherwise stated.
2. Registration
To bid in any HeritageBids auction, you must register a free account and separately register for each individual auction. Registration is subject to approval at our sole discretion. We reserve the right to decline registration to any applicant without providing a reason.
By registering, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding contract
- All information provided during registration is accurate and complete
- You will honor any bids placed under your account
3. Bidding
All bids placed at HeritageBids are legally binding. By placing a bid, you agree to purchase the lot at that price plus the buyer’s premium if you are the winning bidder.
HeritageBids offers two bidding methods:
- Absentee bidding — you submit a maximum bid in advance and our system bids incrementally on your behalf up to that maximum
- Live bidding — you place bids in real time during the auction
The highest bidder at the close of the auction is the winning bidder, subject to the reserve price being met. If the reserve price is not met, the lot is passed unsold.
HeritageBids reserves the right to withdraw any lot at any time before the hammer falls, without liability.
4. Buyer’s Premium
The buyer’s premium is 15% of the hammer price and is payable in addition to the hammer price. The buyer’s premium is included in your invoice and is non-negotiable.
Example:
- Hammer price: $1,000
- Buyer’s premium (15%): $150
- Total due: $1,150
5. Payment
Payment is due within 7 days of receiving your invoice. HeritageBids accepts the following payment methods:
- Major credit cards (Visa, Mastercard, American Express)
- Bank transfer (wire transfer)
Invoices are processed securely through Stripe. HeritageBids does not store credit card information.
Failure to pay within the required period may result in:
- Cancellation of the sale
- Suspension or permanent removal of bidding privileges
- Legal action to recover the outstanding amount
6. Sales Tax
Sales tax may be applicable depending on the buyer’s location and the nature of the item. Where applicable, sales tax will be added to the invoice and is the buyer’s responsibility.
7. Condition of Lots
All lots are sold as described in the catalog. HeritageBids makes reasonable efforts to accurately describe the condition of each lot, including any known defects, repairs or restoration.
Condition reports are available upon request for all lots. We strongly encourage all bidders to review the condition report before placing a bid.
All sales are final. HeritageBids does not accept returns except in cases of proven material misrepresentation.
8. Provenance and Title
HeritageBids makes reasonable efforts to verify the provenance and title of all lots. By consigning to HeritageBids, sellers warrant that they have clear and unencumbered title to the items consigned.
HeritageBids is not liable for any disputes regarding title that arise after the sale.
9. Shipping and Delivery
Buyers are responsible for all shipping costs unless otherwise stated. HeritageBids coordinates shipping through specialist art and antique handlers.
All shipments are fully insured during transit. Risk of loss passes to the buyer upon delivery to the carrier.
Delivery timelines are estimates and not guaranteed. HeritageBids is not liable for delays caused by the carrier or by circumstances beyond our control.
10. Limitation of Liability
HeritageBids’s liability to any buyer shall not exceed the hammer price paid for the relevant lot. We are not liable for any indirect, consequential or special damages arising from a purchase.
11. Governing Law
These Terms of Sale are governed by the laws of the State of New York. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New York County.
12. Changes to These Terms
HeritageBids reserves the right to update these Terms of Sale at any time. The current version will always be published at heritagebids.com/terms-of-sale. Continued participation in our auctions constitutes acceptance of the current terms.
